Section 1

This Privacy Policy sets out the principles for processing personal data obtained through the online store (hereinafter referred to as: “Online Store”).

The owner of the Online Store and data controller is Courtworx Sports Ltd, with registered office at Unit 18A Buriton Business Park, Mapledurham Lane, Petersfield, Hampshire, GU32 3NJ, registered under Company Number 11532233, VAT Registration Number GB326185013, hereinafter referred to as Courtworx Sports Ltd.

Personal data collected by Courtworx Sports Ltd through the Online Store is processed in accordance with the General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

Courtworx Sports Ltd takes particular care to respect the privacy of Customers visiting the Online Store.

Section 2 – Types of Data Processed, Purposes and Legal Basis

Courtworx Sports Ltd collects information concerning natural persons making purchases via the Online Store, natural persons conducting business or professional activities in their own name, and natural persons representing legal entities or organisations with legal capacity, hereinafter collectively referred to as Customers.

Customer personal data is collected when:

  • placing an order through the instant checkout form, for the purpose of fulfilling the sales contract. Legal basis: necessity to perform the sales contract (Article 6(1)(b) GDPR);
  • using the review service, for the purpose of fulfilling the contract for electronic services. Legal basis: necessity to perform the review service contract (Article 6(1)(b) GDPR).

When placing an order via the instant checkout form, the Customer provides:

  • email address;
  • address data: postcode and town/city; country; street with house/flat number;
  • first name and surname;
  • telephone number.

In the case of Business Customers, the above data scope is additionally extended to include:

  • business name;
  • VAT number.

When using the review service, the Customer provides:

  • email address;
  • first name.

While using the Online Store Website, additional information may be collected, including: IP address assigned to the Customer’s device, domain name, browser type, access time, and operating system type.

Navigation data may also be collected, including information about links clicked or activities undertaken in the Online Store. Legal basis: legitimate interest (Article 6(1)(f) GDPR), consisting of facilitating the use of services and improving functionality.

Personal data may also be processed to establish, pursue, or enforce claims. Legal basis: legitimate interest (Article 6(1)(f) GDPR).

Providing personal data to Courtworx Sports Ltd is voluntary in connection with concluded sales contracts or service provision contracts via the Online Store Website. Failure to provide required data during checkout prevents order placement and fulfilment.

Section 3 – Data Recipients and Storage Period

Customer personal data is transferred to service providers used by Courtworx Sports Ltd in operating the Online Store. Depending on the role of these providers, they act as either data processors (following instructions) or data controllers (independently determining purposes and methods).

  • Data Processors: hosting providers, accounting services, marketing systems, traffic analysis systems, and SureCart (used for ecommerce checkout and order processing).
  • Data Controllers: payment providers such as PayPal (including PayPal Pay in 3 instalments) and associated banking services.

Service providers are based in the United Kingdom and within the European Economic Area (EEA). PayPal may also transfer and process data outside the EEA in accordance with its own Privacy Policy.

Customer personal data is stored:

  • Where consent is the legal basis, until consent is withdrawn, and thereafter for the limitation period of claims (generally six years, three years for business-related claims).
  • Where contract performance is the legal basis, as long as necessary to perform the contract, and thereafter for the limitation period of claims.

When making a purchase in the Online Store, personal data may be transferred to courier companies for the purpose of delivering ordered goods.

Navigation data may be used to provide better customer service, statistical data analysis and adapting the Online Store to Customer preferences, as well as administering the Online Store.

Upon request from authorised state authorities, Courtworx Sports Ltd discloses personal data to entitled state authorities, including the Crown Prosecution Service, Police, Information Commissioner’s Office, Competition and Markets Authority, or Ofcom.

Section 4 – Cookies and IP Address

The Online Store uses small files called cookies. These are stored by Courtworx Sports Ltd on the end device of persons visiting the Online Store, if the web browser allows it. A cookie file usually contains the domain name from which it originates, its expiration time and an individual identifier. Information collected using such files helps adapt products offered by Courtworx Sports Ltd to individual preferences and actual needs of Online Store visitors. It also enables the development of general visit statistics.

Courtworx Sports Ltd uses two types of cookies:

  • Session cookies: deleted after ending a browser session. They do not collect personal or confidential data.
  • Persistent cookies: remain stored until deleted or expired. They also do not collect personal or confidential data.

Courtworx Sports Ltd uses cookies for:

  • authenticating the Customer in the Online Store and ensuring the Customer session;
  • analysis, research and statistics to improve structure and content.

External cookies may also be used for presenting multimedia content (e.g., YouTube), collecting statistics via Google Analytics, or presenting trust certificates. Customers can manage or disable cookies in their browser settings.

Courtworx Sports Ltd may collect Customer IP addresses for technical diagnostics, statistical analysis, site administration, and security purposes.

Section 5 – Rights of Data Subjects

Customers have rights under GDPR, including:

  • Right to withdraw consent (Article 7(3));
  • Right to object to processing (Article 21);
  • Right to erasure – “right to be forgotten” (Article 17);
  • Right to restrict processing (Article 18);
  • Right of access to data (Article 15);
  • Right to rectification (Article 16);
  • Right to data portability (Article 20).

Requests will be fulfilled without undue delay, no later than one month, or within two further months if justified by complexity or volume.

Section 6 – Security

Courtworx Sports Ltd provides secure and encrypted connections during data transmission. SSL certificates are used to protect personal data. Courtworx Sports Ltd never requests login details or passwords by email.

Section 7 – Privacy Policy Changes

This Privacy Policy may be changed, and Customers will be informed 7 days in advance of any changes.
