Section 1 – General Provisions

These Terms and Conditions set out the general terms, conditions and method of sale conducted by Courtworx Sports Ltd with registered office at Unit 18A Buriton Business Park, Mapledurham Lane, Petersfield, Hampshire, GU32 3NJ, through the online store (hereinafter referred to as: “Online Store”) and set out the terms and conditions for the provision of electronic services by Courtworx Sports Ltd.

Section 2 – Definitions

  • Business Days – means weekdays from Monday to Friday, excluding bank holidays and public holidays.
  • Delivery – means the actual activity of delivering Goods to the Customer by the Seller, through the Carrier, as specified in the order.
  • Carrier – means the courier company that the Seller cooperates with for the delivery of Goods.
  • Customer – means an entity for whom, in accordance with these Terms and Conditions and legal provisions, electronic services may be provided or with whom a Sales Contract may be concluded.
  • Consumer – means a natural person acting for purposes wholly or mainly outside that person’s trade, business, craft or profession.
  • Customer Account – means an individual panel for each Customer, automatically created when the Customer completes an order through SureCart checkout. For convenience, a linked Customer Account is also created on slingerbaguk.co.uk to allow access to the support portal.
  • Trader – means a natural person, legal person or unincorporated body (whether or not having separate legal personality) who is acting for purposes wholly or mainly within that person’s trade, business, craft or profession.
  • Seller – means Courtworx Sports Ltd, Unit 18A Buriton Business Park, Mapledurham Lane, Petersfield, Hampshire, GU32 3NJ, Company Number 11532233, VAT Registration Number GB326185013, email: sales@courtworxsports.com, who is also the owner of the Online Store.
  • Online Store Website – means the websites under which the Seller operates the Online Store, operating under the domain courtworxsports.com.
  • Goods – means products presented by the Seller through the Online Store Website that may be the subject of a Sales Contract.
  • Durable Medium – means any instrument which enables the Customer or the Seller to store information addressed personally to them in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the information stored.
  • Sales Contract – means a distance sales contract concluded on the terms set out in these Terms and Conditions between the Customer and the Seller.

Section 3 – General Provisions and Use of the Online Store

All rights to the Online Store, including intellectual property rights to its name, internet domain, Online Store Website, as well as to patterns, forms, and logos placed on the Online Store Website (except for logos and photos presented on the Online Store Website for the purpose of presenting goods, the copyrights to which belong to third parties) belong to the Seller. Their use may take place only in the manner specified and in accordance with these Terms and Conditions and with the written consent of the Seller.

The Seller will make efforts to ensure that the use of the Online Store is possible for Internet users using all popular web browsers, operating systems, device types and Internet connection types. Minimum technical requirements enabling the use of the Online Store Website are: a web browser version of at least Chrome 89, Firefox 86, Safari 14, Edge 88 or newer, with Javascript enabled, cookies accepted, and an internet connection with a bandwidth of at least 1 Mbps. The Online Store Website is optimised for a minimum screen resolution of 1024×768 pixels.

The Seller uses cookies to ensure the proper functioning of the Online Store Website. Customers may disable cookies in their browsers, though this may cause difficulties or prevent use of the Online Store Website.

It is prohibited for Customers to provide unlawful content or to use the Online Store in a manner contrary to law or good practice.

Section 4 – Orders

Information contained on the Online Store Website does not constitute an offer by the Seller within the meaning of UK contract law, but only an invitation to Customers to make offers to conclude a Sales Contract.

Customers may place orders in the Online Store through product-specific links that lead directly to SureCart instant checkout pages. There is no traditional shop page, cart, or multi-step checkout process. Each product has a dedicated checkout page, and the Customer completes their purchase by entering the required details and confirming payment.

Placing an order constitutes the Customer making an offer to the Seller to conclude a Sales Contract for the Goods selected. A Sales Contract is concluded when the Seller confirms acceptance of the order via email to the Customer.

Section 5 – Payments

Prices on the Online Store Website are displayed inclusive of VAT. Delivery costs, where applicable, are calculated automatically within the SureCart checkout form, based on the delivery location.

The Customer may choose the following payment methods for ordered Goods:

  • PayPal payment system (order fulfilment begins after confirmation of payment from PayPal);
  • PayPal Pay in 3 instalments for eligible customers (subject to PayPal’s approval and terms);
  • Credit or debit card payment through PayPal’s secure gateway (no PayPal account required).

Payment must be made immediately upon placing the order.

Section 6 – Delivery

The Seller provides Delivery only to the following permitted locations:

  • United Kingdom (GB)
  • Ireland (IE)
  • Northern Ireland (NI)
  • Isle of Man (IM)
  • Jersey (JE)
  • Guernsey (GG)

The Seller is obligated to deliver Goods that are the subject of the Sales Contract without defects. Delivery time is generally next Business Day for most UK mainland locations. Delivery to Republic of Ireland, Isle of Man, Jersey, Guernsey, Northern Ireland, and remote UK locations may take longer. Delivery costs are calculated automatically during checkout.

Section 7 – Warranty

The Seller ensures Delivery of Goods free from physical and legal defects. All Goods sold carry a standard 12-month manufacturer warranty from the date of delivery. Customers may purchase an extended warranty option to extend coverage to 24 months at the time of purchase.

If Goods have defects, the Customer may:

  • Request repair or replacement of the defective Goods. The Seller is obligated to replace defective Goods with fault-free ones or remove the defect within a reasonable time without excessive inconvenience to the Customer;
  • Demand a price reduction or withdraw from the Sales Contract if the Seller cannot repair or replace the Goods within a reasonable time.

Warranty claims should be made through the support portal (see Section 9). The Seller will respond to complaints within 14 days of receipt.

Section 8 – Right of Withdrawal

Consumers who have concluded a Sales Contract may withdraw from it within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The withdrawal period begins when the Consumer takes possession of the Goods. The Consumer may withdraw by submitting a statement in writing to the Seller’s address (Unit 18A Buriton Business Park, Mapledurham Lane, Petersfield, Hampshire, GU32 3NJ) or by email to sales@courtworxsports.com. To meet the deadline, it is sufficient to send the statement before the expiry of the 14-day period.

In case of withdrawal, the Seller will refund all payments received, including standard delivery costs, within 14 days of receiving the Consumer’s statement of withdrawal. Refunds may be withheld until the Goods are returned or proof of return is provided.

The Consumer must return Goods to the Seller immediately, and no later than 14 days after withdrawal, to the Seller’s address: Unit 18A Buriton Business Park, Mapledurham Lane, Petersfield, Hampshire, GU32 3NJ. The Consumer bears the direct cost of returning Goods.

Returned Goods must be in their original condition, unused, and in original packaging to be eligible for a full refund. The Consumer is liable for any reduction in the value of Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Section 9 – Customer Support

All customer support after purchase is provided through the Slinger Bag UK support portal. When a Customer creates an account on courtworxsports.com during checkout, a linked account is automatically created on slingerbaguk.co.uk to allow access to the support portal.

The support portal allows customers to upload images and videos (maximum 20MB), communicate directly with support representatives, and track support requests.

The Seller does not provide telephone support. All communication must be conducted through the support portal. General enquiries, including withdrawal and return notices, may be submitted to sales@courtworxsports.com.

Customer support is available Monday to Friday during Business Days. The Seller is closed on public holidays and bank holidays. The Seller aims to respond to all support tickets within 14 days of submission.

Section 10 – Final Provisions

The Seller bears liability for non-performance or improper performance of contracts, but in the case of contracts concluded with Traders, the Seller bears liability only in cases of intentional damage and within the limits of actual losses incurred.

These Terms and Conditions may be saved by printing, downloading, or storing them at any time from the Online Store Website.

In case of disputes arising from Sales Contracts, the parties will strive to resolve matters amicably. UK law is the applicable law for resolving all disputes arising under these Terms and Conditions.

Consumers may use out-of-court methods of complaint handling and claim pursuit. More information is available via Trading Standards and consumer advice services. The Online Dispute Resolution platform is available at http://ec.europa.eu/consumers/odr/.

The Seller reserves the right to change these Terms and Conditions. All orders accepted before the effective date of changes will be fulfilled under the Terms and Conditions in force on the day the order was placed. Changes take effect 7 days after publication on the Online Store Website. Customers will be informed of changes 7 days in advance via email containing a link to the updated Terms and Conditions.

Contracts with the Seller are concluded in the English language.
